Terms & Conditions

1. Definitions

“User” means any person accessing the Platform. “Professional” means a verified real-estate agent, agency, developer or other business user. “Listing” means property or service content published by a Professional. “Enquiry” or “Lead” means a request or expression of interest submitted through the Platform.

2. Nature of the service (marketplace & facilitator)

Luxnova operates a marketplace and lead-generation platform that connects Users with independent Professionals. Luxnova is not a party to, and does not act as agent, broker, escrow, adviser or guarantor in, any property transaction, tenancy, sale, purchase, financing or service arranged between Users and Professionals unless expressly stated in a separate written agreement.

Any contract for the sale, purchase, letting or provision of property or services is concluded solely between the User and the relevant Professional and/or third parties. Luxnova is not responsible for the acts, omissions, representations, solvency or conduct of any Professional, User or third party.

3. Eligibility & accounts

You must be at least 18 years old and legally capable of entering into binding contracts. Private individuals may browse the Platform and submit Enquiries without creating an account. Professional accounts are subject to verification, approval and ongoing compliance requirements. Private individuals may not register as professional publishers.

You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of any account credentials. You must notify us promptly of any unauthorised use of your account.

4. Listings, content & accuracy

Professionals are solely responsible for the accuracy, legality, completeness and currency of their Listings and content. Prices, availability, yields, projections, floor areas, images and descriptions are indicative and may change without notice. Luxnova does not warrant the accuracy or completeness of any Listing or User-generated content.

Estimated yields, valuations, returns, residency outcomes, tax positions and legal conclusions presented anywhere on the Platform are indicative only, are not guaranteed, and do not constitute advice.

5. Enquiries, leads & communications

When you submit an Enquiry, you consent to your details being transmitted to the relevant Professional and stored by Luxnova in order to facilitate a response and for the operation of the Platform. Operational handling of your Enquiry is separate from any optional marketing consent (see the Privacy Policy and Data & Marketing Policy).

You agree to provide accurate contact information, including a valid international telephone number and current country of residence, and to use communications for legitimate purposes only.

6. Subscriptions, fees & payments (Professionals)

Professional plans, Key Club memberships and add-ons are billed in advance on the cycle presented at checkout (typically annually), exclusive of VAT or other applicable taxes unless stated otherwise. Fees are non-refundable except where required by mandatory law.

Entitlements are activated only upon confirmed payment. Where card payments are processed by a third-party payment provider, subscriptions are activated by verified server-side confirmation and not merely by a client-side success page. You authorise recurring charges where you select a recurring plan until cancelled in accordance with these Terms.

7. Acceptable use

You must not: publish false, misleading, fraudulent, discriminatory or unlawful content; scrape, harvest or extract data other than as expressly permitted; interfere with the security or integrity of the Platform; misrepresent your identity or authority; circumvent verification; upload malware; or use the Platform to launder money or evade sanctions.

8. Intellectual property

The Platform, its software, design, trademarks, logos, and all content provided by Luxnova are owned by or licensed to Luxnova and are protected by intellectual-property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purpose. Professionals grant Luxnova a licence to host, display and promote their Listings.

9. Disclaimers

The Platform is provided “as is” and “as available”. To the maximum extent permitted by law, Luxnova disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

Nothing on the Platform constitutes legal, tax, financial, investment, immigration or residency advice. You must obtain independent professional advice before making any decision.

10. Limitation of liability

To the maximum extent permitted by applicable law, Luxnova, its owners, founders, directors, officers, employees, agents and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profit, revenue, data, goodwill or opportunity, arising out of or in connection with your use of the Platform or any transaction with a Professional or third party.

To the maximum extent permitted by law, the total aggregate liability of Luxnova arising out of or relating to the Platform shall not exceed the greater of (a) the fees you paid to Luxnova in the twelve (12) months preceding the event giving rise to the claim, or (b) EUR 100. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence or for fraud.

11. Indemnity

You agree to indemnify and hold harmless Luxnova and its owners, founders and personnel from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of your breach of these Terms, your content, or your use of the Platform.

12. Third-party links & services

The Platform may contain links to or integrations with third-party websites, payment providers and services. Luxnova is not responsible for third-party content, policies or practices, and your use of them is at your own risk and subject to their terms.

13. Suspension & termination

We may suspend, restrict or terminate access to the Platform, remove content, or revoke verification at any time where we reasonably believe there is a breach of these Terms, a legal or regulatory requirement, a risk to Users, or fraudulent or harmful conduct.

14. Force majeure

Luxnova shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, war, terrorism, civil unrest, epidemic, pandemic, failure of utilities or telecommunications, or governmental action.

15. Governing law & dispute resolution

These Terms and any dispute arising out of or in connection with them shall be governed by, and construed in accordance with, the laws of the jurisdiction in which Luxnova is established, without prejudice to any mandatory consumer-protection rights available to you under the law of your country of residence.

The parties shall attempt in good faith to resolve any dispute amicably before commencing formal proceedings. Nothing in this clause prevents a consumer from bringing proceedings, or requiring proceedings to be brought, in accordance with mandatory law applicable to them.

Severability & local-law adaptation

Each provision of this document is severable. If any clause, or part of a clause, is held to be invalid, unlawful or unenforceable under the mandatory law of any jurisdiction, that clause (or the affected part) shall be deemed modified to the minimum extent necessary to be valid and enforceable, and all remaining provisions shall continue in full force and effect.

Where a mandatory statutory right, disclosure or protection applicable to you in your country or region is not expressly reflected in this document, that right shall nonetheless apply to the extent required by law, and the remainder of this document shall remain valid and effective.

Where you believe that a specific term, condition, data-handling practice or consumer protection required by your local or regional law is not yet addressed here, please contact us at hello@luxnova.estate with an enquiry. We will review your request and, where appropriate, incorporate the required provision on a jurisdiction-specific basis while all other provisions continue to apply.

17. Changes & entire agreement

We may update these Terms from time to time. The version published on the Platform at the time of your use applies. Continued use after changes constitutes acceptance. These Terms, together with the Privacy Policy, Cookie Policy and Data & Marketing Policy, constitute the entire agreement between you and Luxnova regarding the Platform.
